Tennessee has fired the first shot across the bows in controlling online
commerce ! They sent a cease and desist letter to a small Tennessee
based Online Auction. http://www.auctionvillage.com
This is probably the most defensible on the part of the state, of the
activities they are planning on attempting to regulate. It is an auction
house, and it is based in their state. It remains to be seen if the
state can stake out territory in cyberspace, and regulate it!
Have you written and/or called your state representatives??? Let's try
to not hand the internet to them on a silver platter!

OAUA is spearheading this issue, and the more support they can get,
the more likely they will help resolve this issue to benefit online
auction users. http://www.auctionusers.org/

eBay was unavailable for about 1 hour from 0731 to 0829 PT. The
backup system took over, and they are continuing to work towards
faster recovery time. Here was then a quickly fixed problem with
connections, that was resolved by 1043PT. They are down now
again as I am writing this at 4:20 AM right coast time.

A new gift giving guide is designed to help you figure out what to give
someone. http://www.ebay.com/givingguide

There is also a note about the state licensing problem . Quote Please
be assured that we are working diligently on this because of its
importance to all of us in the eBay marketplace. As always, we want
to thank you for the healthy discussion of this and similar issues in
the eBay community. End quote. http://www2.ebay.com/aw/announce.shtml

eBays lawyers visited the NC Auction Commissions lawyers
last week and we all await the results ! There are many questions
in the minds of the NC legislatures that remain unanswered. NOW
is the time to help make their minds up for them.

AuctionWatch has added an appraisal service. It is provided by three
in house appraisers, two of whom come from Butterfield and Butterfield,
supplemented by other specialists. The cost is $19.95 per item, buy four
get fifth free. Take digital images, fill out the form, submit it to AW
and pay via SSL on a credit card. Your appraisal in back to you within
three business days. It is archived on the site with access restricted
to the person who paid for the appraisal. You need a browser that is
more recent than version 3. Our concerns about this service (questions
sent to AW) are:
Are the appraisers ASA accredited? http://www.apo.com
Are these true appraisals or just value estimates? The first can be
used for insurance claims, loans, estate tax etc, and the second
just to give you an idea of what something is worth.
Are the AW appraisers working for others or themselves in a way
That might create conflict of interest problems?

AW has implemented a new TOS policy. No one may address an
individual, only what the individual has posted. Don’t know how
they separate the two. Any post that violates this rule will get the
poster warned the first time, then suspended for a subsequent
violation.

And finally, some AW users have revealed that the spouse of the
AW moderator has been using two Ids on AW. This was with the
knowledge of the AW management. This is a direct violation of
the stated AW TOS, and has damaged the credibility of the people
who run AW.
