eBay US- feels they have solved peak hour slowdowns and outages
by making some adjustments to the site. They were going to shut
down for a short period tonight but feel they have isolated and
fixed the problem. They continue to monitor for a reoccurrence
of problems.

We finally received an answer from eBay on section 7 of
the User Agreement. After several email messages today, with
eBay legal, it finally came down to-
QUOTE -
EBAY LAWYER– quote - I don't understand what else you need from me...
TAG – quote - Sir,
WHAT I NEED FROM YOU PRIOR TO MIDNIGHT PACIFIC TIME IS-
As per your user agreement revision, I need expressed written
permission to monitor or copy your web pages or the content
contained therein and expressed written permission to copy,
reproduce, alter, modify, create derivative works, or publicly
display any content from your website, in order to continue to
create and publish TAGnotes, and critique, comment on,
and discuss eBay in public and private forums on and off eBay.
Your revised user agreement which goes into effect at midnight
PT requires this. Thank you - THE AUCTION GUILD
EBAY LAWYER - quote - I am not going to give you express an permission.
I have already told you that the type of reporting and minor copying
you are doing appears to be permissible. As long as you stay within the
parameters of what you are doing now, I don't see any problem. Thanks.
TAG – quote - Sir,
Well, THAT is a clear answer, though begs the question WHY NOT? If eBay
requires expressed written permission, why not grant it given specified
circumstances? I will file your letters with my attorney, and hope that
eBay does not change it's corporate mind and attempt to NARU The Auction
Guild or any one else at some future date for activities that you
currently say "appears to be permissible". Thank you for the time and

This appears to be as close as we can get to evidence that will be
usable in an effort to reinstate someone who is NARU based on their
violating section 7, when they quote or discuss eBay. The emails with
full headers will be posted in the TAGnotes site files. We request that
you ask permission before copying them. We promise that it wont take us
as long to respond as eBay, nor will we be as uncooperative.

Still no further response from eBay about the spamming incident.
Their next response (or lack of response) will determine if we file
formal complaints with BBBonline and TRUSTe. Last information request
sent 23 Oct.

Ebay has NARUed carsonline/Kruse/eBay but Kruse is still on eBay as
krcollectible (registered this ID on 20 Sep 99). They just ended all
their auctions early.
