At 00:34:45 PT on 15 May, ebaY posted that they took the site
down from 00:00 PT to 00:30 PT for emergency maintenance. Users
posted at 03:08:37 PT they were getting intermittent error messages
when trying to view categories. At 04:19:37 PT ebaY's email system
went down and at 05:13:15 PT the About Me pages were down.
05:52:56 PT user reported problems continued with My ebaY down,
and at 06:24:37 PT listing was down. The email system was still
not working as of 07:08:23 PT. At 11:34:46 PT the feedback system
became non functional, joined at 12:07:37 PT by a non working relist
function. At 12:45:31 PT users were receiving This functionality
is currently unavailable messages and at 13:53:39 PT page can not
be displayed messages were showing up whilst trying to access various
ebaY functions. The problems appeared to clear up, with only very
intermittent and short lived glitches for the rest of the day.

ebaY SELLERS check you accounts!!! ebaY was supposed to post
the refunds from the relist fees owed to sellers from the March relist
fiasco, caused by an ebaY coding error on 15 May 01. According to
the reports TAG has seen on the OAI/OTI chat boards, the credits ebaY
is posting to accounts does not come close to what sellers say they are
due. Sellers did NOT get their guaranteed refunds for their relisting
fees on auctions that sold the second time around. Relist fees on second
time sold auctions were not automatically credited. This problem ran
from 14 Mar to 23 Mar 01. Though ebaY knew about this problem on the
15th they did not even acknowledge it until the 23rd. They had evidence
both from users and from at least one third party service provider. On
29 March ebaY had a long post on the AB
about the relisting problem. During the time frame of the problem,
relisted items were treated as new listings, so sellers were charged
a second insertion fee without the ability to receive a refund if the
item sold. ebaY said they couldn't automatically identify which
items were relisted during this period so due the appropriate relist
credit. ebaY said they would provide sellers an estimated credit
based upon each seller’s relist history and the number of eligible
items (ones that were relisted and closed successfully), that were
listed between 14 and 20 Mar. This excludes Dutch and Premier
listings. Again, seller reports say that they are NOT getting the
refunds they are due. If you use auction management software
or systems, many of those utilities will allow you to check your
relisted and sold items for the 14 - 23 March timeframe. If the
refunds you received did not match what you think you should have
received from ebaY, send a refund request to ebaY. ebaY can not keep
this money as it is not theirs to keep. This is not a discretionary
refund on ebaYs part but a required one, it is illegal for them to not
make refunds if you have evidence to prove your assertions.

On 16 May the site ran well for most of the day except for the
ongoing list of problems that can be viewed at
http://www.auctionguild.com/generic.html?pid=32

Starting tomorrow, 17 May, ebaY will end auctions that have WWII
memorabilia that has Swastikas and other Nazi emblems on them, and
will no longer permit the sale of collectibles associated with
murderers.

ebaY will take the site down for regularly scheduled maintenance
on Fri 18 May from 01:00 PT to 03:00 PT.

Rolex is suing ebaY Germany accusing it of trademark infringement and
unfair competition. For article go to

The same article reported that ebaY is trying to renegotiate a contract
with Disney over the Disney's Go.com deal from Feb 2000 to provide
auction services to Go.com. In that deal, ebaY agreed to pay a $30 mil
to Go.com over four years. Disney is shutting down Go.Com. ebaY still
hosts an auction site for Disney.

For sellers who feel they have not had their refunds, that ebaY is
restraining trade, defrauding sellers by not providing the services
paid for or other situations not dealt with to your satisfaction,
you can file reports with The Attorney General of California and
